LIVINGSTON, Chief Justice. The appellant, Robert E. Lee Dentman, was indicted by the Grand July of Calhoun County, Alabama,
for the offense of murder in the first degree. On a plea of not guilty, trial was had and the jury returned a verdict of guilty
as charged and fixed punishment at imprisonment in the penitentiary for life. The trial court sentenced the appellant accordingly,
and he perfected an appeal to this court. The following appears without conflict from the evidence on the trial of the case:
