This cause is before the Court on appeal of a judgment of Conviction of capital felony for which a sentence of death was imposed. We have jurisdiction. Art. V, 3(b)(1), Fla. Const. Robert Earl DuBoise appeals his conviction of first-degree murder, three convictions of violation of probation, and the sentence of death. The state cross-appeals the trial Courts order arresting judgment on a jury verdict of guilt of attempted sexual battery. We affirm the Convictions, reverse the order arresting judgment, vacate the sentence of death, and remand with instructions to the trial court to impose a sentence of life imprisonment.
